ZINIA has the exclusive right to use its content and products. We guarantee that our goods correspond to your order and meet the normal expectations you may have of them, taking into account the specifications of the product.

Zinia undertakes to the best of its ability to guarantee the accuracy and updating of the information published on the website. The company reserves the right to correct the content at any time without notice. However, Zinia cannot guarantee that the information on the website is correct, accurate and understandable. Such information does not constitute a guarantee or obligation of Zinia to the Internet user. Photos, graphics and descriptions of items offered for remote sale are for informational purposes only and are not binding on Zinia. You may obtain additional information by contacting Zinia. While every effort is made to ensure that the color and pattern of the Articles displayed on the Site accurately reflect the original Articles, variations may occur, particularly due to technical limitations of your computer’s ability to display colors. Therefore, Zinia cannot be held liable for minor errors or inaccuracies in the photographs or images of the Articles displayed on the Site.

Availability

Zinia reserves the right to change the items offered on the site at any time and without notice. Such changes will not affect orders already placed. Before you place an order, the Site describing each Item will inform you

Prices

All our prices in the webshop are in € and include VAT. An overview of the shipping costs for the product to be ordered is always displayed on the product page of the product to be ordered.
Prices are subject to change.

All prices are subject to printing and typesetting errors. No liability is accepted for the consequences of printing and typesetting errors. In case of printing and typesetting errors, the entrepreneur is not obliged to deliver the product according to the incorrect price.

Shipping costs in Europe:
Free shipping for orders above €500. Below this amount, costs will be charged.

Belgium: €6,50
Germany, Netherlands, Luxembourg: €10
France: €15,5
United Kingdom: €25
Other European countries: €20

Shipping costs outside Europe:
Shipping costs outside Europe are standard €50.

The invoiced prices are those in effect on the date of the order, provided that the Article(s) ordered are available at that time.

Zinia reserves the right to change the prices of the Article(s) at any time without prior notice, but such changes will not apply to orders already placed by you.

Purchases, through the Site, of Zinia items are not eligible for VAT refunds.

Order

We make every effort to deliver the order to you as soon as possible. Therefore, we use the following shipping period if the products are in stock and do not require personalization or customization:

Standard shipping in Belgium: delivery within 3 to 5 working days.
Standard shipping in Europe: delivery within 7 working days.
Standard shipping outside Europe: delivery within 10 working days

If for any reason we are unable to meet the delivery time, we will of course notify you as soon as possible.

All our orders come with a track & trace code. You will receive this by e-mail at the time of shipment.

The confirmation of your order contains the order number, the total amount of the order, shipping costs and information about the delivery date, as well as the main characteristics, quantity and price of the purchased item(s).

When the ordered items are shipped to the delivery address you provided, Zinia will send you an email to inform you of the shipment and that payment has been received.

Payment for a personalized order from Zinia is made after the request has been approved.

On the date or within the time frame communicated to you by Zinia before your order was confirmed or, if no time frame was communicated, no later than thirty (30) days after the order date, unless there is a justified delay;
If that Item is temporarily unavailable, within the time frame you were notified and accepted when you added that item to your shopping cart on the site, as well as before your order was accepted.

If the delivery of items is delayed, you will be contacted as soon as possible and steps will be taken to minimize the consequences of the delay. Provided that Zinia will use its best efforts to minimize the delay.

If the parcel service fails to deliver the package (after three unsuccessful attempts) and the package is returned to Zinia’s warehouse, Zinia will attempt to contact you twice during the four (4) weeks following receipt of the package. If you do not respond or contact us within these four (4) weeks, Zinia will refund the order after deducting shipping costs and send you a confirmation email to the address you provided when placing the order.

 

Delivery

The entrepreneur will take the greatest possible care when receiving and executing orders for products and when evaluating requests for the provision of services. Due to the nature of the product, the ordered product will be delivered within the following period:

Standard shipping in Belgium: delivery within 3 to 5 working days.
Standard shipping in Europe: delivery within 7 working days.
Standard shipping outside Europe: delivery within 10 working days.

Unless it concerns a personalized or customized product, in that case the delivery date will be communicated to you by e-mail. Standard delivery time for personalized and customized products is 20 to 30 working days. Delivery times are only binding if expressly confirmed by ZINIA in writing.

Right of Withdrawal

Any customer has the right to cancel their purchase without giving reasons within the reasonable 14-day cooling-off period. This period begins on the day the delivery has left the warehouse. During the cooling-off period, the customer shall treat the products received (unopened and unused) and the packaging with care. If the customer wishes to exercise their right of withdrawal, they must return all products including the original packaging to ZINIA. Please contact us in advance by email for this purpose.

If the goods have been used, encumbered or damaged in any way by the purchaser, the purchaser’s right of withdrawal will lapse. ZINIA will ensure that the full purchase amount (excluding shipping costs incurred) is refunded to the purchaser within 14 business days of receipt of the return shipment.

Consequences of revocation

We may withhold reimbursement until we have received and inspected the goods. You must return or hand over the goods to us without delay, but in any case no later than 14 days from the date the delivery left the warehouse. You are on time if you return the goods before the 14-day period has expired. You are responsible for the direct cost of returning the goods.

Opened, discontinued, broken or damaged products cannot be returned. Products can only be exchanged if they are unopened or unused and whose seal has not yet been broken. Packaging must be in original condition and without damage.

So treat the product with care and make sure it is well packed when returning it.

Zinia cannot be held responsible if the item is lost during shipment.

How can I return received products?

If you exercise your right of withdrawal, the product must be returned with all delivered accessories and in its original condition and packaging. We will then refund the order amount due within 14 days of notification of your return (excluding shipping costs incurred), provided the product has already been returned in good order.

If you return a product, you will not receive a replacement item. You can order a new product via the webshop. If you have received a wrong article or an article with an error, this must always be returned. All return costs will then be charged to ZINIA. Damages to items received can be reported by email within 48 hours of receiving your order:
info@zinia-belgium.be.

To exercise your right of withdrawal, you must inform us of your decision to revoke your purchase by clearly stating your intention. To stay within the revocation period, you only need to send your revocation notice before that period has expired.

In accordance with Article VI.53, 3° and 5° of the Belgian Code of Economic Law, the right of withdrawal does not apply to purchases of items manufactured to the customer’s specifications, customized or clearly personalized, or to items that you

ZINIA is not liable if and to the extent that it cannot fulfill its obligations as a result of force majeure. Force majeure includes any strange cause, as well as any circumstance, which in all reasonableness should not be at its risk. Delay or non-performance by our
suppliers, internet disruptions, electricity disruptions, e-mail traffic disruptions or disruptions or changes in technology provided by third parties, transport difficulties, strikes, government measures, supply delays, negligence on the part of suppliers and/or auxiliaries,
illness of staff, in auxiliary personnel or means of transport are expressly considered force majeure.

In cases of force majeure, ZINIA reserves the right to suspend its obligations and is also entitled to rescind all or part of the agreement, or to demand that the content of the agreement be amended in such a way that execution remains possible. Under no circumstances shall ZINIA be obliged to pay any penalty or compensation.

Liability

In particular, Zinia shall not be liable for:

Any inaccuracy, error or omission regarding the information available on the Website.
Any damage resulting from automated breaches by third parties modifying information on the Website;
Zinia shall not be liable for any direct or indirect damages resulting from fraudulent access to your Account or the Site, or your inability to access your Account or the Site.

Zinia uses every means to ensure the security of files generated
using personal information collected on the Site.

In no event shall Zinia be liable for any unforeseeable loss or damage. Losses or damages are foreseeable if it is clear that they will occur or if you and Zinia know at the time of entering into the agreement that they may occur and, for example, have discussed them with Zinia during the sales process. Nothing in these Terms and Conditions excludes Zinia’s liability for willful misconduct, gross negligence, death or personal injury.

Complaint Procedure

We recommend that you first raise complaints with us by sending an e-mail to: info@zinia-belgium.be. If this does not lead to a solution, it is possible to register your complaint via the European Commission’s ODR platform. This ODR platform can be found at http://ec.europa.eu/odr. If
your complaint is not already being processed elsewhere, you are free to submit your complaint via the European Union platform.
